Terms of service

1. The service

WhyBuy.my ("we", "us") provides branded short links, hosted link pages, QR codes, and related marketing services under the whybuy.my domain. By purchasing or using the service you ("customer") agree to these terms.

2. Accounts and requests

Link names are issued after review. Submitting a request does not reserve a name or create a contract. We may decline any request at our discretion, including for availability, quality, trademark, or acceptable-use reasons.

3. Fees, billing, and renewal

Fees are stated on our pricing page and are charged through PayPal. Monthly and annual subscriptions renew automatically at the then-current rate until cancelled. Premium link names are leased for annual terms and priced individually.

You may cancel at any time through your PayPal account or by emailing support@whybuy.my. Cancellation stops future billing; fees already paid for the current term are generally non-refundable except where we fail to deliver an approved name.

4. Licence, not ownership

All whybuy.my link names, including premium names, remain our property. You receive a limited, non-exclusive, non-transferable licence to use your assigned name while your plan is current. You may not sell, sublicense, or transfer a name without our written consent.

5. Non-payment and reclamation

If a payment fails or a plan lapses, the link may stop resolving immediately. After a grace period of thirty days from the lapse, we may reclaim the name and reassign it. We will attempt to notify you at your email of record before doing so.

6. Customer responsibilities

You are responsible for ensuring that all content, destination URLs, products, claims, endorsements, disclosures, and marketing activities comply with applicable laws, advertising rules, platform policies, affiliate-network terms, privacy obligations, and intellectual-property rights.

7. Acceptable use

Your use of the service is subject to our acceptable use policy, which forms part of these terms. We may refuse, suspend, redirect, remove, or reclaim any link that is misleading, fraudulent, infringing, unlawful, abusive, deceptive, harmful, technically unsafe, or otherwise inconsistent with that policy.

8. Service levels and changes

We work to keep links available and accurate but do not guarantee uninterrupted service, specific click volumes, traffic, rankings, conversions, or revenue. We may change features, pricing for future terms, infrastructure, or these terms with reasonable notice.

9. Analytics

Click and page statistics are provided as a convenience and are approximate. They are not a certified measurement service and should not be used as the sole basis for commission or payment disputes with third parties.

10. Disclaimers and limitation of liability

The service is provided "as is" and "as available" without warranties of any kind, express or implied, to the maximum extent permitted by law. To the maximum extent permitted by law, our total liability arising out of or relating to the service is limited to the fees you paid to us in the twelve months preceding the claim. We are not liable for indirect, incidental, special, consequential, exemplary, or lost-profit damages.

11. Indemnity

You agree to indemnify and hold us harmless from claims, damages, losses, liabilities, and expenses arising from your content, destinations, promotions, disclosures, or breach of these terms.

12. Termination

Either party may terminate at any time. We may suspend or terminate immediately for violations of these terms or the acceptable use policy, for non-payment, or where required by law or a platform provider.

13. Governing law

These terms are governed by the laws of the State of Utah, USA, without regard to conflict-of-law rules. Venue for disputes is the state or federal courts serving Weber County, Utah.
